Rental Agreement

This Rental Agreement ("Agreement") is entered into between Hoops Rental ("Company", "we", "us") and the individual or entity booking the rental ("Renter", "you").

1. Equipment Description

The Company agrees to rent to the Renter one (1) trailer-mounted basketball hoop system, including the trailer, hoop assembly, backboard, and any accessories provided (collectively, the "Equipment").

2. Rental Period

The rental period begins at the time of delivery/pickup and ends at the agreed-upon return time as specified in the booking confirmation. The Renter must ensure the Equipment is accessible for pickup at the end of the rental period.

3. Rental Fees and Deposit

• The rental fee is based on the daily rate multiplied by the number of rental days, as shown during booking
• A deposit is required to secure the reservation and is applied toward the total rental cost
• The remaining balance is due before or at the time of delivery
• Additional fees may apply for delivery outside the standard service area, late returns, or damage

4. Renter Responsibilities

The Renter agrees to:

• Use the Equipment only for its intended purpose (basketball play)
• Operate the Equipment safely and in accordance with all instructions provided
• Provide a flat, paved, and stable surface for Equipment placement
• Ensure adequate adult supervision when minors are using the Equipment
• Not move, tow, or relocate the Equipment from the designated setup location
• Not modify, disassemble, or alter the Equipment in any way
• Not allow anyone to hang from, swing on, or climb the backboard, rim, or any part of the Equipment
• Cease use during severe weather conditions including lightning, high winds (over 25 mph), or heavy rain
• Return the Equipment in the same condition as received, reasonable wear and tear excepted
• Report any damage, malfunction, or safety concern to the Company immediately

5. Prohibited Uses

The following uses are strictly prohibited:

• Use on grass, gravel, dirt, or any non-paved surface
• Use near power lines, trees, or overhead obstructions
• Dunking, hanging on the rim, or applying excessive force to the backboard
• Use while under the influence of alcohol, drugs, or any impairing substance
• Use that violates any local ordinances, HOA rules, or property restrictions
• Commercial subletting or re-renting of the Equipment

6. Damage, Loss, and Theft

The Renter is fully responsible for the Equipment during the rental period. The Renter agrees to pay the full cost of repair or replacement for any damage, loss, or theft that occurs, including:

• Physical damage to the hoop, backboard, trailer, or accessories
• Damage caused by misuse, negligence, or violation of this Agreement
• Damage caused by weather if the Renter failed to follow weather guidelines
• Theft or disappearance of the Equipment while in the Renter's possession

7. Assumption of Risk

The Renter acknowledges that basketball and physical activities involve inherent risks of injury. The Renter and all users of the Equipment assume full responsibility for any injuries sustained during use. The Renter agrees to inform all participants of the risks involved.

8. Indemnification and Hold Harmless

The Renter agrees to indemnify, defend, and hold harmless the Company, its owners, officers, employees, agents, and affiliates from and against any and all claims, demands, losses, damages, liabilities, costs, and expenses (including reasonable attorney's fees) arising out of or related to:

• The Renter's use or misuse of the Equipment
• Any injury to any person arising from use of the Equipment
• Any damage to property caused by the Equipment while in the Renter's possession
• Any breach of this Agreement by the Renter

9. Limitation of Liability

To the fullest extent permitted by law, the Company's total liability under this Agreement shall not exceed the total rental fees paid by the Renter. The Company shall not be liable for any indirect, incidental, special, or consequential damages.

10. Setup and Location Requirements

• The setup location must be on a flat, level, paved surface (concrete or asphalt)
• Minimum clearance of 10 feet in all directions from obstacles
• No overhead obstructions within 20 feet above the playing surface
• The Renter is responsible for obtaining any necessary permits or permissions for Equipment placement
• The Company reserves the right to refuse setup at any location deemed unsafe

11. Weather and Unsafe Conditions

If weather or other conditions make it unsafe to deliver, set up, or use the Equipment, the Company may postpone or cancel the rental. In such cases, the Renter will be offered a full refund or the option to reschedule at no additional charge.

12. Late Return

If the Equipment is not available for pickup at the agreed-upon time, a late fee equal to the prorated daily rental rate will be charged for each additional day or partial day, with a minimum charge of 2 hours at the hourly equivalent rate.

13. Cancellation

The Renter may cancel the booking subject to the cancellation policy outlined in the Terms of Service. Cancellation requests must be submitted in writing.

14. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the state in which the Company operates.

15. Electronic Acceptance

By checking the acceptance checkbox during the booking process, the Renter acknowledges that they have read, understood, and agree to all terms of this Agreement. This electronic acceptance constitutes a legally binding agreement equivalent to a handwritten signature. The date, time, and IP address of acceptance are recorded.

16. Entire Agreement

This Agreement, together with the Terms of Service, constitutes the entire agreement between the parties and supersedes all prior agreements, representations, and understandings.
